We, plumnetworks GmbH (hereinafter „PLUMNETWORKS“ are happy that you are using the application BYOT (hereinafter „APP“) and the website www.plumnetworks.eu. With this APP, users can create bets, chat with other users, participate in other users’ bets, etc. Data protection and data security are very important to us when you use our APP. We therefore want to inform you at this point which of your personal data we collect when you use our APP and for which purposes they are used. The website www.plumnetworks.eu serves the general presentation of our company.

Since legislative changes or changes in our internal company processes can make it necessary to adapt our privacy statement, please read through this privacy statement regularly. The privacy statement can be accessed, saved and printed at http://www.byot.at/privacy/en at any time.
This privacy statement applies to the use of PLUMNETWORKS’ APP, which can be downloaded in the Apple App Store and the Google Play Store, as well as for the Internet services of PLUMNETWORKS in general, which can be accessed at www.plumnetworks.eu well as its various subdomains.
Personal data is information which can be used to find out personal or material circumstances about you (e.g. name, address, telephone number, date of birth or email address). Information which does not enable us to identify you (or only with a disproportionate level of effort), e.g. due to anonymization of the data, is not considered personal data.
We store access data without a personal connection, e.g. the name of your Internet service provider, the page from which you visit us, the names of the requested files and the date of their retrieval. These data are exclusively evaluated in order to improve our services and do not allow us to make any conclusions about your person. If you want to use our APP, e.g. by creating bets, participating in the competition, etc., you will be required to supply additional data. These are the data required for the respective procedure, e.g. your name if you create a user account, or your email address if you win a competition. We use the data we collect about you for the provision of our offered products and services as well as for the operation and improvement of our APP. We only use your personal data in order to be able to offer you an extensive service via our APP and to deliver the desired performance. There will be no further use of your personal data. Your data will not be used for promotional purposes, except for the cases outlined below. Except for the cases outlined below, your personal data will not be transferred to third parties, unless we are legally required to disclose data (disclosure to prosecuting authorities; disclosure to public authorities who receive data due to legal regulations, e.g. social security institutions, financial authorities, etc.) or unless we appoint third parties bound to professional secrecy in order to enforce our claims. In particular, personal data are used as follows.

a) User account
In order to use the APP, you must create a user account. We will only use the data you provide when creating your user account, without your separate permission, to fulfill and execute the APP’s services. You can register either with your telephone number or with your Facebook account. As a first step, you will be asked to provide your telephone number or your Facebook account. If you register with your telephone number, we use a so-called double opt-in procedure, i.e. your account will only be created after you confirm your registration by entering the code sent to you in a confirmation SMS. This ensures that only the user himself or herself can create a user account as the owner of the indicated telephone number. This confirmation must take place within a narrow time frame after receiving the confirmation SMS, otherwise the registration process must be started anew. If you register via your Facebook account, we store those data which Facebook discloses to us for this purpose. You can then enter your name and create a user name, a user picture and a password. Optionally, you can also provide your email address. We also use your telephone number for searching your phone book in order to establish whether you are storing the phone numbers of other users of the APP. If we find any matches, we will inform you about it. If you delete your user account, your data will be blocked for further use and irrevocably deleted after the retention periods according to fiscal and corporate law, unless you explicitly approved the further use of your data.

b) Competition
In order to participate in the competition, you also have to create a user account (see point a above). By creating a user account according to point a above, you automatically enter a competition. In order to be able to transfer/deliver the prize to the weekly winner, we additionally need the winner’s PayPal account and corresponding email address. We are authorized to transmit the winner’s data (name + email address) to any cooperation partners in order to enable delivery of the prize (if the delivery is not made by us). These companies will only be allowed to use your data for the sole purpose of processing the order. As soon as the prize has been fully delivered, your data will be blocked for further use and deleted after the retention periods according to fiscal and corporate law, unless you explicitly approved the further use of your data.

c) Advertising and market research
In addition to using your information for processing your desired services, we also use your information in order to offer you a use of the APP that is focused on your interests as well as to send you occasional emails based on your data with interesting news and suggestions about our company or our range of products and services, according to your individual interests, and we use your data for the evaluation required for this purpose as well as for market research purposes. This technically requires combining your specified data in usage profiles and evaluating them for the purposes mentioned above. This only takes place internally and only for the purposes mentioned above. You can revoke your consent regarding this matter at any time by sending an email to office@byot.at or a letter to our postal address, plumnetworks GmbH, Melchartgasse 9, 1130 Vienna, Austria. If you did not give your consent or if you revoke it, your data will not be used as described in the paragraph above. Of course you can still use PLUMNETWORKS’ services.
Except for in the cases mentioned above, we will not create any personal user profiles. When you access your desired services, our servers only store the data required for providing our various services or for evaluation purposes in anonymized form. They log general information, e.g. when which contents from our range of offers are accessed. We use so-called “cookies” (small text files with configuration elements). Cookies are small text files that are sent from our web server to your browser when you use our APP and which your browser stores on your computer for later retrieval. We only use so-called session cookies (also called temporary cookies), which are only temporarily stored as long as you use our APP..
The cookies we use especially serve the purpose of determining how often our APP is used and by how many users and to be able to see when you stop using our APP. This shows us which area of our APP our users have used. These usage data do not allow us to make any conclusions about the user, however. None of these anonymized collected usage data will be amalgamated with your personal data as per Section 3 of this privacy statement, and all of them will be promptly deleted as soon as the statistical evaluation has been completed. After your session has been ended, as soon as you left the APP, the cookies will be deleted. Most browsers are preconfigured to automatically accept cookies. But you can also disable the storage of cookies or set your browser to notify you before cookies are stored. Users who do not accept cookies may not be able to use certain areas of our APP.
Our APP also contains plug-ins of the social networks „Facebook“(Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA), „Google+“ (Google Inc. 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA), “Twitter”(Twitter, Inc. 1355 Market St, Suite 900, San Francisco, CA 94103, USA) and “WhatsApp” (WhatsApp Inc.650 Castro Street, Suite 120-219 Mountain View, CA, 94041 USA). These are exclusively operated by the respective provider. The plug-ins are recognizable in our APP by the respective buttons of each service. The information about the visit of our APP is forwarded to the respective service.
If you are signed in with the respective service with your personal user account while using our APP (e.g. in another browser session), this service can allocate the use of our APP to your account. With the plug-ins, users can share or post links to relevant websites in social networks such as Twitter, Facebook, WhatsApp or Google+ or recommend their contents. When you actively interact with these plug-ins, e.g. by clicking the respective button or leaving a comment, this information is directly transmitted to the respective service and stored there. If you would like to prevent this type of data transmission, you will have to log off from your user account of the respective service before starting our APP. This website uses Google Analytics, a web analytics service by Google Inc. (“Google”). Google Analytics uses so-called “cookies", i.e. text files which are stored on your computer and permit to analyze your use of the website. The information about your use of this website generated by the cookie is usually transmitted to a Google server in the USA and stored there. Google may also transmit this information to third parties to the extent that this is required by law or if third parties process these data on behalf of Google.
If IP anonymization is activated on this website, your IP address will however be truncated by Google within the area of member states of the European Union or in other states which are party to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to a Google server in the USA and truncated there. Please note that this website uses Google Analytics with the extension code “gat._anonymizeIp();” in order to guarantee the anonymized collection of IP addresses (so-called IP masking).
Google will use this information on behalf of the operator of this website for the purpose of evaluating how you use the website, compiling reports on website activities and providing further services related to website and internet usage to the website operator. We will only store your personal information for as long as this is permitted by law. Upon request, we will gladly inform you which data we have stored about your person. In the event that, notwithstanding our efforts to keep the data accurate and up to date, information is recorded which is incorrect, this will be amended immediately.

If you want us to delete the stored data, this deletion will also be performed immediately upon your request. If deleting the data is not possible for legal reasons, the respective data will be blocked instead.
